1. Introduction

Welcome to Syampya, an online aggregator accessible at Syampya.com (the "Syampya"), operated by sole proprietor Tair Maratuly Baygunov ("we," "our," "us"). By using Syampya, you agree to these Terms of Use (the "Terms") and consent to the collection, use, and processing of your data as outlined in our Privacy Policy. Syampya primarily serves as a aggregator for companies and organizations to showcase their events, such as forums, conferences, and presentations of innovations or "know-how." It enables entities from industries like pharmaceuticals, finance, technology, agriculture, logistics, education, healthcare, energy, telecommunications, retail, and manufacturing, as well as other sectors seeking to innovate and engage with their audiences to connect with their target audiences and promote meaningful engagements. Large companies can leverage the aggregator to organize industry-specific gatherings, launch events, and knowledge-sharing sessions to a broader audience.

Additionally, Syampya provides users with an accessible aggregator to share a variety of planned activities, encompassing sports events, entertainment, concerts, trips, cultural programs, workshops, and volunteer opportunities. Beyond this, institutions such as museums, theaters, and community organizations are encouraged to leverage Syampya for promoting their specialized initiatives. 2. Definitions

Syampya: The website and its associated services provided by us.

User: Any person accessing or using Syampya.

Unregistered User: Users who browse announcements without registering. They cannot rate events, leave reviews, or receive notifications.

Registered User (Attendee): Users who create a personal account by providing contact details. They can access all features unavailable to unregistered users, including rating events, writing reviews, and receiving notifications.

Event Organizer: Users who register specifically to post event-related content. Organizers are responsible for the accuracy of their posted information and can apply to publish their events via their personal dashboard.

Administrator: An authorized representative of Syampya responsible for reviewing and approving or rejecting event applications submitted by Event Organizers. Administrators, acting on behalf of Syampya, reserve the right to decline an application with or without providing reasons.

Content: Information posted by Event Organizers, including event details, links, and contact data. Only Event Organizers are permitted to submit applications for publishing event information on the aggregator. These applications are subject to review and approval by the aggregator's moderators or administrators.

3. Conditions of Use
3.1 Roles and Permissions:
Unregistered Users: Can view announcements but are restricted from interacting with content (e.g., rating or reviewing events).
Registered Users (Attendees): Have access to interactive aggregator features, such as rating events, writing reviews, and receiving notifications, but they cannot post or approve event announcements.
Event Organizers: Have the ability to submit an application to post their events. Applications are reviewed by moderator and/or administrator and must be submitted at least seven (7) days before the event date to allow sufficient review time.
3.2 Posting Content: Event Organizers may post Content related to planned events across all categories available on the aggregator, such as cultural, social, educational, volunteer, sports, entertainment, technological, industrial, and other events. Event Organizers must ensure the accuracy and legality of their postings. Applications to publish events may be accepted or rejected at the discretion of the aggregator's moderator or administrator. Administrators also reserve the right to remove already published announcements at their discretion, with or without providing a reason.
If an application to publish an event is rejected, any subsequent request for reconsideration may take an extended period to review or may not be reviewed at all, at the sole discretion of Syampya.
3.3 Prohibited Activities: Users must not:
Post false, misleading, or harmful information.
Engage in activities that violate applicable laws or the rights of others.
Use Syampya for unauthorized or fraudulent purposes.
Violations of Section 3.3 may result in the responsible Event Organizers or Users being held liable under the jurisdiction of their country of residence/location and/or the country where the event is being conducted.
4. User Responsibilities
4.1 Content Accuracy: Event Organizers are solely responsible for ensuring the accuracy, legality, and relevancy of the Content they post. Event Organizers must also ensure that their Content does not infringe any third-party rights, including intellectual property or privacy rights.
4.2 Compliance with Submission Deadlines: Event Organizers must submit their applications for event publication at least seven (7) days before the event date. Failure to meet this deadline may result in the rejection of the application.
4.3 Compliance with Laws: Users agree to comply with all applicable laws and regulations when using Syampya. This includes, but is not limited to, local, national, and international regulations governing the organization and promotion of events.
4.4 Event Safety: Event Organizers are responsible for ensuring that appropriate safety measures are in place at their events, in compliance with all applicable laws and regulations. Syampya does not assess or guarantee the safety of any event listed on the aggregator. Attendance at any event listed on Syampya is solely at the discretion and risk of the attendee, who remains fully responsible for their own decision to participate. The fact that an event is listed on Syampya does not constitute an endorsement or recommendation by Syampya.
4.5 Cooperation in Dispute Resolution: Users agree to cooperate in good faith with Syampya in resolving any disputes or complaints that may arise in connection with their use of the aggregator.
5. Limitation of Liability
5.1 Exclusions of Liability:
We shall not be liable for:
The accuracy, completeness, timeliness, or reliability of Content posted by Users, including Event Organizers.
Changes, cancellations, postponements, or the quality of events posted and/or promoted on Syampya.
Any loss, damage, or expense arising directly or indirectly from reliance on information available on Syampya, including but not limited to direct, indirect, incidental, or consequential damages.
Syampya shall not be held liable for any failure or delay resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, network failures, or other unforeseen events.
This exclusion applies irrespective of whether such losses arise under contract, tort, statute, or otherwise.
5.2 Geographical Scope of Liability:
This limitation of liability is governed by and construed in accordance with the laws of the Republic of Kazakhstan. Where relevant, it also reflects the laws of any other jurisdiction applicable to the User or the location of the Event. Users acknowledge their obligation to comply with all such relevant laws.
6. Intellectual Property
6.1 Syampya and its design, features, underlying technology, and all associated intellectual property rights are exclusively owned by us. Any commercial use of Syampya, its Content, or associated intellectual property without prior written consent is strictly prohibited. Unauthorized use may result in legal action.
6.2 Users retain ownership of the Content they post but grant us a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content for the purpose of operating, promoting, and improving Syampya. Users warrant that they own or have the necessary rights and permissions to grant this license and that their Content does not infringe upon any third-party rights.
7. Dispute Resolution
7.1 Complaints: Users may submit complaints or inquiries regarding Syampya-related issues through the feedback form available on the Syampya website. Syampya will review and respond to complaints within thirty (30) days of receipt. Syampya reserves the right to request additional information from Users to facilitate the resolution of complaints.
7.2 Governing Law: These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes shall be resolved in the courts of the Republic of Kazakhstan.
